Knowledge standard
A person acts knowingly under subsection (1) if that person intends to sell, purchase, manufacture, deliver, or bring into this state, or to actually or constructively possess, any of the controlled substances listed in subsection (1), regardless of which controlled substance is in fact sold, purchased, manufactured, delivered, or brought into this state, or actually or constructively possessed. §893.135(2).
No early release
Mandatory minimums cannot be suspended/withheld; no parole/discretionary early release before serving the mandatory minimum (except pardon/clemency/conditional medical release). §893.135(3).
Substantial assistance
On state attorney motion, court may reduce/suspend sentence if the defendant provides substantial assistance. §893.135(4).
Conspiracy
Conspiracy to traffic is punishable as the trafficking offense. §893.135(5).
Mixture weight
For trafficking thresholds, use the total weight of the mixture (controlled substance plus any other substance). If multiple mixtures contain the same controlled substance, add their total weights together. §893.135(6).
